Magistrates, Police, and People: Everyday Criminal Justice in Quebec and Lower Canada, 1764-1837 Fyson, Donald
Vendor: Abebooks.com Price: 77.00 $The role and function of criminal justice in a conquered colony is always problematic, and the case of Quebec is no exception. Many historians have suggested that, between the Conquest and the Rebellions (1760s-1830s), Quebec's 'Canadien' inhabitants both boycotted and were excluded from the British criminal justice system. Magistrates, Police, and People challenges this simplistic view of the relationship between criminal law and Quebec society, offering instead a fresh view of a complex accord. Based on extensive research in judicial and official sources, Donald Fyson offers the first comprehensive study of the everyday workings of criminal justice in Quebec and Lower Canada. Focussing on the justices of the peace and their police, Fyson examines both the criminal justice system itself, and the system in operation as experienced by those who participated in it. Fyson contends that, although the system was fundamentally biased, its flexibility provided a source of power for ordinary citizens. At the same time, everyday criminal justice offered the colonial state and colonial elites a powerful, though often faulty, means of imposing their will on Quebec society. This fascinating and controversial study will challenge many received historical interpretations, providing new insight into the criminal justice system of early Quebec.

A Mirror for Magistrates and the Politics of English Reformation
Vendor: Abebooks.com Price: 24.95 $Perhaps no other work of secular poetry was as widely read in Tudor England as the historical verse tragedy collection A Mirror for Magistrates. For over sixty years (1559–1621), this compendium of tragic monologues presented in the voices of fallen political figures from England's past remained almost constantly in print, offering both exemplary warnings to English rulers and inspiring models for literary authors, including Spenser and Shakespeare. In a striking departure from previous scholarship, Scott Lucas shows that modern critics have misconstrued the purpose of the tragic verse narratives of the Mirror, approaching them primarily as uncontroversial meditations on abstract political and philosophical doctrines. Lucas revises this view, revealing many of the Mirror tragedies to be works topically applicable in form and politically contentious in nature. Lucas returns the earliest poems of A Mirror for Magistrates to the troubled context of their production, the tumultuous reign of the Catholic Queen Mary (1553–1558). As Protestants suffering from the traumatic collapse of King Edward VI's "godly" rule (1547–1553) and from the current policies of Mary's government, the Mirror authors radically reshaped their poems' historical sources in order to craft emotionally moving narratives designed to provide models for interpreting the political failures of Edward VI's reign and to offer urgent warnings to Marian magistrates. Lucas's study also reveals how, in later poems, the Mirror authors issued oblique appeals to Queen Elizabeth's officers, boldly demanding that they allow the realm of "the literary" to stand as an unfettered discursive arena of public controversy. Lucas thus provides a provocative new approach to this seminal but long-misunderstood collection, one that restores the Mirror to its rightful place as one of the greatest works of sixteenth-century English political literature.

The Christian and the Magistrate: Roles, Responsibilities, and Jurisdictions
Vendor: Abebooks.com Price: 2.59 $What is the Biblical definition of a civil magistrate? Should Christians be subject to them? Should civil governments be subject to God? Is physical resistance to authority ever justifiable? Under what circumstances? And what is a Christian's role with respect to the civil sphere? 16th century Swiss Reformer Pierre Viret once expressed his feelings of political turmoil: "By nature I have always loved peace, and was always horrified at all dissensions and troubles." Despite the man's peace-loving nature, however, God chose to place Viret in some of the most politically tumultuous situations imaginable throughout his life. In these times Viret was compelled to search the Scriptures in an effort to instruct his congregations-as well as countless others asking his advice-on the Biblical definition and response to civil government, war, resistance against authorities, tyrants, and many other political matters. The writings contained in The Christian and the Magistrate are a collection of some of the applications Viret offered of the Biblical truths pertaining to magistrates and the Christian's duty to them.

United States Magistrates in the Federal Courts : Subordinate Judges
Vendor: Abebooks.com Price: 2.99 $Written for social scientists who study the judiciary, legal scholars, judges, and others who are interested in the workings of the federal courts, this volume offers a comprehensive examination of the role of U.S. magistrates--the relatively invisible subordinate judicial officers within the federal district courts. The study is unique in its use of an observation methodology: the author was able to study U.S. magistrates during all of their daily activities and observe their interactions with other actors in the federal judiciary. Particularly valuable are its insights into such functions as pretrial conferences, meetings with litigants, and other situations normally beyond the purview of scholars and the public. The author focuses throughout on both the development of the magistrates' varied roles and their consequences for the federal judicial system. After examining magistrates' roles within several representative courts in detail, the author analyzes the factors which influence the development of these diverse roles and identifies the specific effects--both planned and unplanned--that the subordinate judicial officers have upon the court system. Smith refutes a commonly held view that district judges control the definition of magistrates' roles and concludes that in some cases, especially with regard to the coercion of litigants, the magistrate system's effects cannot be seen to be completely beneficial. In addition, the book contains an in-depth study of the appointment process for magistrates complete with a case history of the merit selection committee process. The author documents the influence of district judges over the merit selection process, adding concrete support to scholarly arguments about the inherently political nature of judicial selection.
